Submission of audited balance sheets and other financial statements as required in the BDS Clause 17, for the last five years to demonstrate the current soundness of the

Bidder's financial position and its prospective long term profitability.

Bidder Certification of Compliance with attachments

The Peak annual turnover calculated as total certified construction work payments received for contracts in progress or completed within the past Five years.

The average annual turnover calculated as total certified payments received for contracts in progress or completed within the last 5 years must exceed 200,000,0000.00

 The bidder failure to submit documents for Authentication of Audit report and Annual Turnover from Addis Ababa Audit board /Ethiopia  Audit board will result in disqualification from the tender process. The Audit Report shall be valid if only the income tax is paid prior to bid submission date and authenticated by Addis Ababa Audit board /Ethiopia  Audit board, and it shall be validated from Addis Ababa Audit board /Ethiopia  Audit board after requesting through formal letter. The bidder failure to submit documents for Authentication of Audit report and Annual Turnover from Addis Ababa Audit board /Ethiopia  Audit board will result in disqualification from the tender process. The bidder submitted document for audit report and construction turn over found fraud after authenticated from Addis Ababa Audit board /Ethiopia  Audit board and Ministry of Revenue shall be disqualified from the tender process, block-listed from EED future tender process and the bidder shall be accused by law for fraudulent act. Any Bankruptcy with in the last five years will result disqualification from the tender process.

The Bidder must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the cash-flow requirement.

The Bidder must demonstrate access to, or availability of, financial resources at least 50,000,000.00 ( fifty millon)  such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the following cash-flow

requirement:

Valid GC/BC-2 certificate of competence

 Bidder has to submit a valid tax clearance certificate issued by the tax authority in accordance with ITB Clause 4.5(b)(iii).

Bidder has to submit valid business license indicating the stream of business in which the Bidder is engaged, in accordance with ITB Clause 4.5(b)(i);

In case of Partnerships, Consortium or Joint Ventures, the bidder submit a separate Beneficial Ownership Disclosure Form for each member; disclose at least one of the following: -

1)    Directly or indirectly holding 10% or more of the shares.

2)    Directly or indirectly holding 10% or more of the Voting Rights or

3)    Directly or indirectly having the right to appoint a majority of the board of Directors or an equivalent governing body of the consultant or

4)    Whether a person directly or indirectly exercises significant influence or control over the Company (tendered)

 In the case of a bid submitted by a Partnership, Consortium or a joint venture (JV), the Bidder has to submit the Form Data on Partnership, Consortium or Joint Ventures, the Agreement governing the formation of joint venture, or letter of intent to form Partnership, Consortium or Joint Venture, including a draft agreement, in accordance with ITB Clause 4.1.

 Bidder has to submit VAT registration certificate issued by the tax authority (in case of contract value specified in BDS Clause 4.5(b)(ii)), in accordance with ITB Clause 4. 5(b)(ii).;

Bidder does have nationality in accordance with ITB Clause 4.2.

Bidder is found to have a conflict of interest as described in ITB Clause 6;

Bidder has to submit business organization registration certificate in accordance with ITB Clause 4.5(c).

Bidder has failed to provide CVs of the Professional staff signed by the staff themselves or by the authorized representative of the Professional Staff.

Bidder has to demonstrate in its Technical Proposal that it will have the personnel for the key positions that meet requirements 

Bidder has to provide in the Bidder Certification of Compliance Form information related to its professional qualification and capability for the period specified in the BDS Clause 15.1;

Bidder has to submit relevant professional practice certificates, if required in BDS Clause 4.5(b)(iv).

Non-performance of a contract did not occur within the last years prior to the deadline for Bid submission, based on all information on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to

the bidder have been exhausted.

Bidder has failed to provide in the Bidder Certification of Compliance Form information about contracts similar to the proposed Works in the number, value, and period 

Bidder has failed to provide in the Bidder Certification of Compliance Form information about major relevant contracts successfully completed 

All pending litigation shall in total not represent more than percent of the Bidder’s net worth and shall be treated as resolved against the Bidder.
