Financial Qualification

Factor	Criteria
Historical Financial Performance	Submission of audited balance sheets and other financial statements as required in the BDS Clause 17, for the past [insert number of years] years to demonstrate the current soundness of the Bidder's financial position and its prospective long-term profitability.
Annual Turnover	The Peak annual turnover calculated as total certified construction work payments received for contracts in progress or completed within the past Five years.
Financial Resources	The Bidder must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the cash-flow requirement.

Legal Qualification

Factor	Criteria
valid business license	Bidder has to submit valid business license indicating the stream of business in which the Bidder is engaged, in accordance with ITB Clause 4.5(b)(i);
Beneficial Ownership Disclosure Form	In case of Partnerships, Consortium or Joint Ventures, the bidder submit a separate Beneficial Ownership Disclosure Form for each member; disclose at least one of the following: - 1) Directly or indirectly holding 10% or more of the shares. 2) Directly or indirectly holding 10% or more of the Voting Rights or 3) Directly or indirectly having the right to appoint a majority of the board of Directors or an equivalent governing body of the consultant or 4) Whether a person directly or indirectly exercises significant influence or control over the Company (tendered)
Business organization Registration certificate	Bidder has to submit business organization registration certificate in accordance with ITB Clause 4.5(c).
valid tax clearance certificate	Bidder has to submit a valid tax clearance certificate issued by the tax authority in accordance with ITB Clause 4.5(b)(iii).
VAT registration certificate	Bidder has to submit VAT registration certificate issued by the tax authority (in case of contract value specified in BDS Clause 4.5(b)(ii)), in accordance with ITB Clause 4. 5(b)(ii).;
Debarment	Bidder has not been debarred by a decision of the Public Procurement and Property Administration Authority from participating in public procurements for breach of its obligation under previous contracts, in accordance with ITB Clause 4.3;

professional practice certificates	Bidder has to submit relevant professional practice certificates, if required in BDS Clause 4.5(b)(iv).

Technical Qualification

Factor	Criteria
Pending litigation	All pending litigation shall in total not represent more than ,,,, [insert required percent] percent of the Bidder’s net worth and shall be treated as resolved against the Bidder.

Terms and Conditions: All bidders must meet the following requirements to qualify for technical evaluation: Terms and Conditions 1 Eligibility: Bidders must be eligible firms under the Federal Democratic Republic of Ethiopia Procurement Law and must not be debarred or suspended. 2 Bid Validity: All bids must remain valid for the period specified in the bidding document, starting from the date of submission. 3 Fixed Contract Price: The contract price is fixed and must cover all costs, including taxes, labor, materials, equipment, and transportation. 4 Technical Evaluation: Only bids meeting the minimum technical specifications and requirements will be considered responsive. The contract will be awarded to the technically compliant bidder offering the lowest evaluated price. 5 Bill of Quantities (BOQ): Bidders must complete the BOQ exactly as provided in the Technical Specifications. Any deviation may result in rejection. Bidders should attach compliance sheet. 6 Completion Period: All works must be completed within 180 calendar days from site handover. A commitment letter confirming this timeline must be submitted. Delays may result in liquidated damages or contract termination. 7 Mobilization: The awarded bidder must mobilize personnel and equipment within three (3) calendar days after site handover. 8 Payment term: Payment shall be made upon full completion, installation, and commissioning of the works, following formal inspection and acceptance by authorized EFDA personnel 9 Bid Security: A hard copy of the bid security amount of 250,000 uploaded to the EGP system must be submitted within 24 hours of bid opening. 10 Private Key Submission: Bidders must provide the private key to the EGP system within 24 hours of bid opening. If not shared within the specified time the bid will remain unopened. 11 Anti-Bribery Compliance: Bidders must complete and submit the Anti-Bribery Pledge Form included in the Specific Requirements section. 12 Alternative Proposals: Not permitted. 13 Termination: The Employer reserves the right to terminate the contract in cases of non-performance or breach. 14 Dispute Resolution: Disputes must first be resolved amicably; if unresolved, they will be referred to arbitration as specified in the contract. 15 Governing Law: The contract will be governed by the laws of the Federal Democratic Republic of Ethiopia. 16 Bidders should list and attach Equipment list, General experience, specific experience, professional qualification, technical qualification, Financial qualification as per the requirement specified in the hard copy section attached in the specific requirement. 17 Additional Requirements: Other conditions are detailed in the hard copy bidding document provided in the Specific Requirements section. 18 Right to Cancel: The Public Body reserves the right to cancel the bid process, in whole or in part, at any time before contract award.
