Bonga University: Procurement of Building Construction

Site Visit is Mandatory and Bidders shall submit Employer Signed and Stamped original document with technical proposal

( if not it shall be a point of rejection)

The Bidder must demonstrate access to, or availability of, as liquid cash or Bank confirmation letter for giving Unconditional Bank line credit facility (which must be UNCONDITIONAL) that shown on current bank statement and Should Be Supported by Confirmation Letter by Respective Bank for contractual advance payments to meet the cash-flow requirements Minimum of the figures indicated in the following requirements;

 Cash-flow requirements Birr 100,000,000.0 (One Hundred Million Ethiopian Birr or equivalent).

 The Submitted document must be original and the document shall be written direct to BONGA UNIVERSITYspecifically for the proposed work.

For bidders (individual firms and local to local JV):

Annual construction turnover of ETB 400,000,000 .00 ETB ( Four hundred million Birr) calculated as total certified payments received for contracts in progress or completed within the last Five (5) years (2013-2017 E.C) (Peak of the last Five years). 

The submitted value shall be accepted only if it is verified with supporting evidence by Chartered certified external auditors and Ethiopian Revenue and Customs Authority.

The audited report must be original or authenticated copy. Bidders must submit attach legal documents of the chartered certified auditor. The financial report of the bidder shall be verified by Ethiopian Revenue and Customs Authority. An original letter for the past five years turns over from the Ethiopian revenue and customs authority should be attached.

The bidder failure to submit documents for Authentication of Audit report and Annual Turnover from Ministry of Revenue will result in disqualification from the tender process. The Audit Report shall be valid if only the income tax is paid prior to bid submission date and authenticated by Ministry of Revenue, and it shall be validated from Ministry of Revenue or Addis Ababa Chamber of Commerce after requesting through formal letter. The bidder failure to submit documents for Authentication of Audit report and Annual Turnover from Ministry of Revenue will result in disqualification from the tender process. The bidder submitted document for audit report and construction turn over found fraud after authenticated from Ministry of Revenue shall be disqualified from the tender process.

Also the last payment certificate should be attached.

Submission of balance sheets audited by a Chartered Certified Auditor and other financial statements as required in the BDS Clause 17, for the last 5 years (2013-2017 E.C) to demonstrate the current soundness of the Applicant's financial position and its prospective long-term profitability. 

 Audited Financial Statement for the last five years or the number of years of establishment of the firm if the firm establishment period is less than five years and same shall be prepared by an independent Certified Chartered Auditor who is registered under Office of the Federal Auditor General (OFAG) or Accounting and Auditing Board of Ethiopia (AABE). Bidders can also check the Certified Chartered Auditors list from OFAG website: (http://www.ofag.gov.et) or AABE website: (http://aabe.gov.et).

 Financial Statement prepared by Authorized Accounts will not be accepted as Audit Report; and

 The Audit Report prepared by an independent Auditor who is not under OFAG or AABE list of Auditors will not be accepted

Having been submitted valid business license indicating the stream of business, in accordance with ITB Sub-Clause 4.5(b) (i).

Having been submitted VAT registration certificate issued by the tax authority (in case of contract value specified in PDS) in accordance with ITB Sub-Clause

Having been registered in the Public Procurement and Property Administration Agency's Suppliers List in accordance with ITB Clause 4.7.

Not having been debarred by decision of the Public Procurement Agency from participating in public procurements for breach of its obligation under previous contracts in accordance with ITB Clause 4.3.

Having been submitted valid business organization registration certificate issued by the country of establishment (foreign Applicants only) in accordance with ITB Clause 4.6

The power of attorney should be written and signed by the legal entity 

Ethiopian Construction Authority  BC-1 or GC -2 registration certificate is required. 

Nationality in accordance with ITB Clause 4.2.

No conflict of interest as described in ITB Clause 6.

Compliance with conditions of ITB Clause 4.5

Having been submitted valid tax clearance certificate issued by the tax authority (domestic Applicants only) in accordance with ITB Clause 4.6

Non-performance of a contract did not occur within the last Five (5) [insert required number of years] years prior to the deadline for Bid submission, based on all information on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the bidder have been exhausted.

It is mandatory to List all current ongoing projects and attach contract agreement, payment certificate and any other relevant document.

The Bidder must have at least thirty (30) staff currently employed. To verify this, the Bidder shall submit the following supporting documents:

·        Payroll records for the latest three (3) months, and

·        Income tax receipts issued by the relevant tax authority for the same period, covering all staff members, including those proposed for key positions.

These documents must clearly demonstrate that the aforementioned Thirty (30) staff are actively employed by the Bidder.

Among the staff mentioned in Sub-Clause 2.1 Applicant must demonstrate that it will have the personnel for the key positions that meet the following requirements: 

NOTES for Evaluation of Key Staff:

 Current company /Head office/Managers are not eligible for any of the position listed.

 For all Professional staff sign originally but not original is automatic rejection 

 Attach a monthly payroll as an evidence Authenticated from the concerned Revenue Authority for the latest three months.

 The proposed personnel must be assigned only for this specific project and the following criteria shall be fulfilled, otherwise the point will be zero. The documents include; 

 The employment agreement testimonials approved by labour and social affairs shall be provided

 Recent CV of staff signed by the employee and approved by the company authorized representative, 

 Renewed Professional license for the year 2018E.C

 Employee-employer agreement valid for the year 2018 E.C 

 Attached educational testimony of the employee 

 Attached copies of previous work experience of the employee approved by the previous employers

 General experience is any practical experience for specific assignment.

 The Applicant shall declare to submit a professional indemnity Insurance to the professionals to be appointed in the positions above from a well-known insurance company registered in the Employers Country (Ethiopia) before contract signing. 

 The required documents for the key professional listed in Table-1, the Bidder should present separate Organization Charts of the proposed key personnel; one for the Site and One for the Head Office establishments. Moreover, qualification will be based on meeting the marking system depicted in the Table above of this Section. The employer reserves the right to accept, reject or waive any variation, deviation or alteration. Variations, deviations or alteration offers and other factors which are in excess of the requirements of the Bidding documents or otherwise result in unsolicited benefits to the Employer shall not be taken into account in Bid evaluation.

All pending litigation shall in total not represent more than 10 % of the Bidder’s net worth and shall be treated as resolved against the Bidder.

The Bidder must demonstrate that it will have available for the implementation of the contract the following equipment listed hereafter:

The Bidder shall have a minimum of five (5) years of experience as a BC-1 or GC -2 .

For Bidders:

The Bidder must have participate as Contractor, sub-contracta and JV that shall be substantially or succesfully completed at least one construction project which is similar in nature and complexity with the proposed work. where the Bidder executed a minimum of 70% of the project with project values of at least ETB 1,000,000,000.00 ETB (One billion ETB) in the last 10 years. The Bidder shall submit copies of the final payment certificate approved by the Client, along with completion certificates and satisfactory project completion testimonials issued by the Client. Failure to do so will result rejection from the bid participation.

OR

The Bidder must have participate as Contractor, sub-contracta and JV that shall be substantially or succesfully completed at least two construction project which is similar in nature and complexity with the proposed work..where the Bidder executed a minimum of 70% of the project with project values of at least ETB 500,000,000.00 ETB (Five hundred million ETB) in the last 10 years. The Bidder shall submit copies of the final payment certificate approved by the Client, along with completion certificates and satisfactory project completion testimonials issued by the Client. Failure to do so will result rejection from bid participation.

Or

The Bidder must have participate as Contractor, sub-contracta and JV that shall be substantially or succesfully completed at least four building project which is similar in nature and complexity with the proposed work...where the Bidder executed a minimum of 70% of the project with project values of at least ETB 333,000,000.00 ETB (Three hundred Thirty Three  million ETB) in the last 10 years. The Bidder shall submit copies of the final payment certificate approved by the Client, along with completion certificates and satisfactory project completion testimonials issued by the Client. Failure to do so will result rejection from bid participation.

Note;

 The bidder shall to attach latest payment certificate approved by Employer, Contract Agreement and Completion Certificate or supporting letter from the Employer for certifying satisfactory completion

 The attached evidence documents shall show Project cost, starting and completion time, Work accomplished up to date from owner clearly.

 The evidence submitted by the bidder shall fulfill the minimum requirement otherwise, the result will be zero (no proportion rating will be applied)

Note: In Case of Jointventure Leader and partner, contribution on the turnover and other important features shall be evaluated as per the new directive Directive No 1073/2025. Article no. 94.5
