| 4.1. Historical Financial Performance |
Submission of audited balance sheets and other financial statements as required in the BDS Clause 17, for the last Five (5) years to demonstrate the current soundness of the Bidder's financial position and its prospective long-term profitability. · Annual financial statements shall be prepared by certified auditors but not by an accountant or accounting firms in case of Ethiopian Bidders. Financial statements prepared by accounting firms will not be accepted.” · The audited financial statement prepared by an independent certified Auditor shall be cross checked with the record from the concerned Revenue and Custom Authority for local Bidders and shall be notarized by appropriate Notary Public and authenticated by the Minister of Foreign Affairs of the Federal Democratic Republic of Ethiopia for Foreign Bidders. Non-notarized and unauthenticated financial statement will not be accepted for foreign Bidders. · While converting the annual turnover of other currencies to ETB, the applicable exchange rate of National Bank of Ethiopia for the date ending of each audit period shall be used.

i) For Local Bidders (individual firms or Joint Venture): Peak annual construction turnover of ETB 590 Million calculated as total certified payments received for contracts in progress or completed within the last Five (5) years ii) For Foreign Bidders (individual firms or Joint Venture): Average annual construction turnover of ETB 1.18 Billion calculated as total certified payments received for contracts in progress or completed within the last Five (5) years iii) For a Joint Venture of Local and Foreign Bidders: Average annual construction turnover of ETB 885 Million calculated as total certified payments received for contracts in progress or completed within the last Five (5) years

| 4.3. Financial Resources |
Cash flow requirement The Bidder must demonstrate (propose) access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, net of current commitments, available to meet the total construction cash flow demands of the subject contract amounts ETB 147.5 Million for local Bidders, and ETB 197 Million for foreign Bidders. The cash flow requirement for the JV b/n local and foreign Bidders is the same with that of foreign Bidders. In case of a JV, the cash flow requirement can be fulfilled in the name of the lead firm. |

| 3.1. General Experience |
For Local Bidders: A minimum of Two (2) years of experience under construction contracts in the role of Contractor, Joint Venture partner or Sub-Contractor prior to the deadline for bid submission. For Foreign Bidders: A minimum of Five (5) years of experience under construction contracts in the role of Contractor, Joint Venture partner or Sub-Contractor prior to the deadline for bid submission. The general experience of a Bidder shall be counted from the date of signing of its first construction contract in the role of Contractor, Joint Venture partner or Sub-Contractor.

| 3.3. History of non-performing contracts |
i) Non-performance of a contract did not occur within the last Two (2) years prior to the deadline for bid submission based on all information on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the Bidder have been exhausted. In addition to the submitted information, the Employer reserves the right to obtain any records of non-performance of the Bidders in the past 2 years from official records within or outside of Ethiopia as a basis for qualification. ii) Poor performance of a contract did not occur within the last One (1) month prior to the deadline for bid submission on ongoing or completed projects of AACRA. (iii) Poor performance of a contract did not occur for the preceding month before the deadline for bid submission on projects of ERA according to ERA’s Monthly Contractor’s Performance Assessment, for a Bidder who has no current contract commitment with AACRA. For a Bidder who has current contract commitment with AACRA, ERA’s Monthly Contractor’s Performance Assessment will not be used for the evaluation of the Bidder’s performance. iv) Poor performance of a contract did not occur within the last six (6) months prior to the deadline for bid submission for a Bidder who has no current contract commitment with AACRA and ERA. If the Employer, based on full documentary evidence, discovers such poor-performance history of a Bidder at any stage of the bidding process before signing of the contract, he will reject the Bidder from the proceeding stages of procurement.

| 3.4. Pending litigation |
All pending litigation shall in total not represent more than Thirty Percent (30%) of the Bidder's net worth and shall be treated as resolved against the Bidder. |
| 3.10. Proposed site facilities |
The Bidder shall provide a detailed description of his construction camp, staff housing arrangements and other facilities including all electrical power and water supply and distribution systems, sewerage and other waste disposal systems and all other things necessary for servicing the Contractor’s camp. |
| 3.6. Current Contract Commitments |
Bidders and each partner to a Joint Venture should provide information on their current commitments on all contracts that have been awarded, or for which a letter of intent or acceptance has been received, or for contracts approaching completion, but for which an unqualified, full completion certificate has yet to be issued. Those applicants who are over committed in the opinion of the employer may not be qualified for this project. |

| 3.11. Sources of construction material |
The Bidders are advised to visit the site and indicate the sources of stone, brick, sand, embankment materials, bitumen and other materials. |
| 3.2. Specific Experience |
For Local Bidders At least one (1) Bridge or Building Project which is at least 75% successfully and substantially completed within the last 10 years as contractor, Joint Venture partner or subcontractor with a value of at least ETB 295 Million. OR At least two (2) Bridge or Building Projects which are at least 75% successfully and substantially completed within the last 10 years as contractor, Joint Venture partner or subcontractor with a value of at least ETB 147.5 Million. For Foreign Bidders At least two (2) Bridge Projects with a minimum of 23 m bridge length which is at least 85% successfully and substantially completed within the last 10 years as contractor, Joint Venture partner or subcontractor with a value of at least ETB 295 Million for each. If the Bidder is a joint venture formed between local and foreign firms, it is the Specific Construction Experience criteria set for Foreign Bidders that shall be met collectively by “All Parties combined”. |
