Qualification Requirements

• Pending litigationAll pending litigation shall in total not represent more than (30%) Thirty percent of the Bidder’s net worth and shall be treated as resolved against the Bidder.Reference: ITB 37.4(e)
• History of non-performing contracts1) Non-performance of a contract did not occur within the last Two (2) years prior to the deadline for Qualification submission based on all information on fully settled dispute or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the Bidder have exhausted. In addition to the submitted information, the respective contract, and where all appeal instances available to the Bidder have been exhausted. In addition to the submitted information, the Employer reserves the right to obtain any records of non-Performance of the Bidders in the past 2 years from official records within or outside of Ethiopia as a basis for qualification.2) If the Employer, based on full documentary evidence, establishes poor performance by any Bidder engaged in similar works in Africa and other developing countries, on any contracts carried out over the last 2 years. Or if a bidder is not performing to the satisfaction of the Employer on the already awarded contracts, then the Employer may use this information in the assessment of the Bidders’ qualifications.3) Evaluation of Contractor’s Performance shall be conducted regularly. Any Contractor’s performance shall be evaluated based on the ERA’s Contractor’s performance assessment framework and rated accordingly. The minimum acceptable performance on ongoing contracts shall be revised to reflect the actual situations. The minimum acceptable performance on ongoing contracts is set from time to time by ERA BOARD.4) If ERA found Nonperformance or poor Performance history of a Bidder at any stage of the tendering process before signing of the contract agreement [except for ERA’s Monthly Contractor’s performance assessment framework, the result of which is considered only for the preceding month before submission of bid], the bidder will be rejected from the proceeding stage of the tendering.5) ERA will request performance of bidders on their current work performance from their respective clients (for those bidders who have no current contract Commitment with ERA) and same will be copied it to the bidders. Hence, bidders are strongly advised to facilities in order to obtain timely response from their clients within ten (10) working days of receiving of such requests. Failure to obtain such response within the stated time might result in rejection of bidders bid and the client may not take any responsibility on the matter.”6) Moreover, for bidders who had on-going and previous relationships with the Client, ERA would further carry out objective and qualitative assessments of the performance of the Contractor on the relevant parameters defined in the respective contracts, including compliance with quality, environmental, and other requirements, in addition to the physical progress to determine performance accomplishment to the satisfaction of the Client.   Reference: ITB 37.4(d)
• Specific ExperianceA Minimum of any type of construction works with a value of ETB 85 Million; ORMinimum of two (2) any type of construction works each with a value of ETB 42 MillionIn all cases, the experiences shall be within the last ten (10) years that has been successfully and substantially completed (70% Completed).Domestic contractors must have completed, within the past ten years, at least one construction project similar in nature to the proposed works. The contractor must have completed at least 70% of the work in a satisfactory and acceptable manner, either as a sole contractor, joint venture member, or subcontractor. or if the contractor may not meet the relevant work experience requirement by having completed one similar project experience across three completed projects of similar nature may be submitted, provided the cumulative value is not less than one-third of the required threshold.In cases where relevant work experience is based on subcontracting or joint ventures, only the portion executed directly by the contractor or corresponding to its share in the joint venture shall be considered. . For the implementation of this Article:a) “Substantially Completed” means a project in which at least 70% (for domestic contractors) b) “Satisfactorily Completed” means a project in which at least 70% of the works have been executed by the contractor within the agreed schedule, including any approved extensions, and where a certificate of satisfactory completion, payment certificate, or other verifiable documentation from the client confirms that the required quality standards have been achievedNote• In addition to the value and surface type of the qualification criteria specified above, bidder’s experience shall be of similar nature and complexity with the subject tender and also shall have similar construction methodology. In relation, bidders shall demonstrate that they have executed major activities involved in a project of similar nature, including the structural pavement layers.• Bidders shall attach their documents showing the completion or substantial completion/satisfactorily completed and in acceptable manner of their specific experience.• While converting the contract amount of other currencies to ETB, the applicable exchange rate should be the exchange rate of the National Bank of Ethiopia for the date of contract signature of each specific experience shall be used.• For the specific construction project experience requirement, the contract value of projects referenced by the bidder shall be adjusted to reflect the current purchasing power of Ethiopian Birr by multiplying with Cn/Co factor, where Cn is the current selling exchange rate of 1 US Dollar to Ethiopian Birr which is taken at the 28th days prior to bid submission date and Co is the selling exchange rate of 1 US Dollar to Ethiopian Birr at the date of signing the contract.• For bidders who have participated as Joint venture or sub-contractors, the amount of experience will be taken considering their shares accordingly.• If the bidder is a joint venture formed between local and foreign firms, it is the specific construction Experience criteria set for foreign bidders that shall be met collectively by “All parties combined”.• Local Bidders: Any experience of the bidder obtained as sub-contracting which is not authenticated by the project Owner or Employer (not the main Contractor) of the project will not be considered; to be considered as an experience, the bidder should also attach all the official Payment collection receipts issued to the main contractor by such sub-contractor with the corresponding invoice attachment. An experience which is not supported by the above documents will not be considered.• Local Bidders: If the bidder’s specific experience as Main (Prime) Contractor is obtained from a client other than the Ethiopian Roads Administration, in addition to the Certificate of Specific Experience (Certificate of substantial completion/satisfactorily completed and in acceptable manner), the bidder should attach all the official payment certificates certified to the main contractor by the Employer, or all the official Payment collection receipts issued to the Employer by the Main Contractor, as appropriate; together with the corresponding invoice attachment. An experience which is not supported by the above documents will not be considered.• Specific experience of obtained outside of Ethiopia shall be notarized by appropriate notary public of the country whereby the project is executed and further should be authenticated by ministry of foreign Affairs of Ethiopia. An experience which is not supported by the above documents will not be considered. The authenticated document should at least contain the following information:o Length and surface type of the projecto Value of the road works,o Share of the joint Venture partners, if there is any o Contract start and completion date• Specific Experience of a bidder obtained through sub-contracting, which is not authenticated by the project Owner/Employer (not the prime contractor) will not be considered. Alternatively, if a bidder has obtained experience by sub-contracting in projects, it should attach all payment receipts certified by the prime contractor. • An experience which is not supported by the above documents will not be considered.”During evaluation, the Client may enquire for additional documents that substantiate the specific experience records indicated by bidders.Reference: ITB 37.4(b)

• Annual TurnoverPeak annual construction turnover of ETB 63 Million calculated as total certified payments received for contracts in progress or completed within the last Five (5) years. Note:                                                                                                                       • If a bidder is awarded and /or recommended for award of any two works contract/s by ERA six months prior to the tender submission date of the subject project until the award of the subject project, the qualification criteria for the construction turnover will be the aggregate of the criteria of the subject project, and that of the awarded contracts and/or those recommended to be awarded. For example, if the tender submission of the subject project is October 05, 2019; and a bidder is awarded and/or recommended for award for two projects by ERA since April 05, 2019; the qualification criteria for the construction turnover will be the aggregate of the criteria of the subject project, and that of the awarded and/ or recommended to be awarded contracts.• During Evaluation, the Average Annual Construction Turnover of a joint (JV) bidder’s “All Parties Combined” shall be determined as follows: First, Each JV partner’s ACT for the respective year will be “Summed up” to obtain the Total ACT of “All Parties Combined” for each year of the last five years; Then, the average of each Year’s Total ACTs of “All Parties Combined” (in the last 5 years) will be taken for the evaluation. If bidders submit their bid in Joint Venture (JV), the construction turnover requirement for each partner (members of the JV) shall not be less than 25%; while for the lead partner of the JV shall not be less than 40%.• The value of total certified payments received in each year (i.e. ACTs) shall be adjusted for inflation of Birr value through multiplying by Cn/Co factor, where Cn is value of 1 US Dollar in Birr on the date 28 days prior to bid submission date and Co is the value of 1 US Dollar in Birr computed using the exchange rate prevailing on the last date of the respective fiscal year.• The basis of computing US dollars value of Birr shall be the selling exchange rate issued by the National Bank of Ethiopia.• The foreign bidders, while converting Annual Construction Turnover (ACT) indicated in other currencies to equivalent amount in ETB, the applicable exchange rate should be the selling exchange rate of Nation Bank of Ethiopia for the date ending of each Fiscal Year.• If the JV is formed between local firms, the peak annual construction requirement will be the aggregate of the peak annual construction turnover of the joint venture partners.• If the JV is formed between foreign and local firms the peak construction turnover requirements for local firms shall not be less than 25% as members of the JV and 40% as lead partner of JV; while the average construction turnover requirement of foreign firms shall not be less than 25% as members of the JV and 40% as lead partner of the JVThe documentary evidences of Audited Financial Statements that are emanated outside the country of the Employer shall be notarized by the authorized body and authenticated by the F.D.R.E Ministry of Foreign Affairs.Reference: ITB37.5(d)
