Terms and Conditions
1. Eligibility Bidders must comply with the procurement laws of the Federal Democratic Republic of Ethiopia and must not be debarred or suspended from participating in public procurement. 2. Bid Validity All bids shall remain valid for the period specified in the bidding document, starting from the date of submission. 3. Evaluation and Award Only bids that meet the minimum technical requirements will be considered responsive. The contract will be awarded to the bidder offering the lowest evaluated price among those that are technically compliant. 4. Bid Security Bidders are required to submit bid security as follows: • A soft copy must be uploaded in the e-GP system at the time of bid submission. • The original (hard copy) must be delivered to the Purchaser’s office within twenty-four (24) hours after bid opening. Failure to submit the required bid security within the specified timeframe will result in rejection of the bid. For Small and Micro Enterprises (SMEs): Instead of bid security, SMEs shall submit a signed and stamped letter addressed to the Ethiopian Food and Drug Authority (EFDA), clearly stating the bid security amount. The letter must be issued by the head of the organizing body and uploaded in the e-GP system before bid closing. Failure to comply will result in rejection. 5. Private Key Submission Bidders must submit their private key through the e-GP system within twenty-four (24) hours after bid opening. Failure to do so will result in disqualification. 6. Anti-Bribery Compliance Bidders are required to submit a duly signed and stamped Anti-Bribery Pledge Form as provided in the bidding document. 7. Power of Attorney A Power of Attorney must be submitted, specifically issued for this bid, authorizing the signatory to act on behalf of the bidder. The document must clearly indicate the Purchaser as the Ethiopian Food and Drug Authority (EFDA). 8. Product Requirements Bidders must clearly specify the brand and model of the items offered. All items must be new and unused; otherwise, the bid will be rejected. 9. Alternative Bids Alternative bids are not permitted. 10. Contract Termination The Purchaser reserves the right to terminate the contract in the event of non-performance or breach of contractual obligations. 11. Dispute Resolution Any dispute arising from this process will first be resolved amicably. If no agreement is reached, the matter will be referred to arbitration in accordance with the contract provisions. 12. Governing Law This procurement process and any resulting contract shall be governed by the laws of the Federal Democratic Republic of Ethiopia. 13. Additional Requirements Further conditions and requirements are detailed in the bidding document, including the Specific Requirements section. 14. Right to Cancel The Purchaser reserves the right to cancel the bidding process, in whole or in part, at any time before contract award, without incurring any liability.
