 The average annual turnover for the period specified does exceed the amount of the Bid Proposal in value specified in the BDS;

 

Legal Qualification

Nationality
Consultant does have nationality in accordance with ITC Sub-Clause 4.2;

 

Beneficial Ownership Disclosure Form
In case of Partnerships, Consortium or Joint Ventures, the Consultant to submit a separate Beneficial Ownership Disclosure Form for each member on the following ways
1)     Directly or indirectly holding 10% or more of the shares.
2)     Directly or indirectly holding 10% or more of the Voting Rights or
3)     Directly or indirectly having the right to appoint a majority of the board of Directors or an equivalent governing body of the consultant or
4)     Whether a person directly or indirectly exercises significant influence or control over the Company (tenderer)
 

 

Valid tax clearance certificate
Domestic Consultant has to submit a valid tax clearance certificate issued by the tax authority, in accordance with ITC Clause 4.5(b) (iii);

 

VAT registration certificate
  Domestic Consultant has to submit VAT registration certificate issued by the tax authority in accordance with ITC Clause 4. 5(b)(ii);

 

Valid business license
Consultant has to submit valid business license indicating the stream of business in which the Consultant is engaged, in accordance with ITC Clause 4.5(b) (i);

 

Conflict of interest
Consultant is found to have a conflict of interest as described in ITC Clause 5;

 

Professional Qualification

Factor Criteria
Consultant Certification of Compliance Form
Consultant has to provide in the Consultant Certification of Compliance Form information related to its professional qualification and capability for the period specified in the BDS Clause 14.1; 

 

Professional practice certificates,
Consultant has to submit relevant professional practice certificates, if required in BDS Clause 4.5(b) (iv);

 

CVs of the Professional staff
 Consultant has failed to provide CVs of the Professional staff signed by the staff themselves or by the authorized representative of the Professional Staff.

 

Consultant Certification of Compliance Form the Team Skill

Consultant has to provide in the Consultant Certification of Compliance Form the Team Skill Matrix identifying the skills that are relevant to the role in the contract team and are required for successful execution of the contract; 

Technical Qualification

Factor Criteria
Technical Proposal Form
 Consultant has to complete its Technical Proposal, Form in accordance with Terms of Reference presented as per template in Section 6;

 

Certificates of satisfactory execution of contracts
 Consultant has to submit Certificates of satisfactory execution of contracts provided by contracting parties to the contracts successfully completed in the period and budget as specified in the BDS Clause 16.3;

 

Major relevant contracts successfully completed
Consultant has to provide in the Consultant Certification of Compliance Form information about major relevant contracts successfully completed in the number and period specified in the BDS;

Notice: 

  • Terms and Conditions: Terms and Conditions 1. Eligibility Bidders must comply with the procurement laws of the Federal Democratic Republic of Ethiopia and must not be debarred or suspended from participating in public procurement. 2. Participation in this procurement is limited to consulting firms that are legally registered and hold a valid business license to provide the consulting services required under this assignment. 3. Bid Validity All bids shall remain valid for the period specified in the bidding document, calculated from the date of submission. 4. The Consultant obtaining the highest final combined technical and financial score shall be ranked first and recommended for contract award, subject to compliance with the requirements, terms, and conditions of the Request for Proposals and the Contract. 5. Bid Security Bidders are required to submit bid security as follows: • A soft copy must be uploaded in the e-GP system at the time of bid submission. • A hard copy must be delivered to the Purchaser’s office within twenty-four (24) hours after bid opening. Failure to submit the hard copy within the specified timeframe will result in rejection of the bid. For SMEs: Small and Micro Enterprises (SMEs) shall submit a signed and stamped letter addressed to the Ethiopian Food and Drug Authority, clearly stating the bid security amount. The letter must be issued by the head of the organizing body and uploaded in the e-GP system before bid closing. 6. Private Key Submission Bidders shall submit their private key through the e-GP system within twenty-four (24) hours after bid opening. Failure to comply will result in disqualification. 7. Anti-Bribery Compliance Bidders must submit the Anti-Bribery Pledge Form, duly signed and stamped, as provided in the bidding document. 8. Power of Attorney: the Bidder shall submit a Power of Attorney specifically issued for this bid, authorizing the signatory to act on behalf of the Bidder. The document must clearly state the name of the Purchaser, Ethiopian Food and Drug Authority (EFDA). 9. Alternative Bids Alternative proposals are not permitted. 10. Contract Termination: The Purchaser reserves the right to terminate the contract in the event of non-performance or breach of contractual obligations. 11. Dispute Resolution Any dispute arising from this process shall first be resolved amicably. If no agreement is reached, the matter shall be referred to arbitration in accordance with the contract provisions. 12. Additional Requirements Further conditions and requirements are detailed in the bidding document, including the Specific Requirements section. 13. Right to Cancel: The Purchaser reserves the right to cancel the bidding process, in whole or in part, at any time prior to contract award, without incurring any liability
