ADDENDUM NO. 01

Subject: Amendment to Bid Security Requirement, Performance Guarantee Requirement, and Extension of Bid Submission Deadline

This Addendum forms an integral part of the Tender Document for the Supply, Installation, Testing, and Commissioning of CT Scan and MRI Equipment and shall be read in conjunction with all other tender requirements.

1. Amendment to Bid Security Requirement

The Bid Security requirement stated in the Tender Document is hereby amended as follows:

• Original Requirement: Bid Security in the amount of ten percent (10%) of the bidder's proposed bid value.
• Revised Requirement: Each bidder shall submit, together with its bid, an irrevocable and unconditional Bank Guarantee in the fixed amount of Ethiopian Birr Three Million (ETB 3,000,000). The Bid Security shall be issued in the name of Pharo Integrated Agriculture and Manufacturing PLC as beneficiary and shall clearly reference the applicable tender number and tender title.

The Bid Security shall:

• Be issued by a reputable and licensed bank;
• Be submitted together with the bid documents;
• Remain valid for a period of 60 days from the bid submission deadline date; and
• Be payable upon first written demand by the Purchaser in accordance with the tender conditions.

Failure to submit the required Bid Security shall result in rejection of the bid as non-responsive.

2. Performance Guarantee Requirement

The successful bidder shall furnish an irrevocable and unconditional Performance Guarantee issued by a reputable and licensed bank in an amount equivalent to ten percent (10%) of the final contract value.

The Performance Guarantee shall be submitted within the timeframe that will be specified in the Letter of Award and prior to contract signing.

Failure to submit the required Performance Guarantee within the stipulated timeframe may result in:

• Cancellation of the award;
• Forfeiture of the Bid Security;
• Disqualification from the current procurement process; and/or
• Award of the contract to another responsive bidder, at the sole discretion of the Purchaser.

3. Forfeiture of Bid Security

The Purchaser shall have the right to call and forfeit the Bid Security if the successful bidder:

• a) Withdraws its bid during the bid validity period;
• b) Refuses to accept the Letter of Award;
• c) Fails to execute the contract within the period specified by the Purchaser;
• d) Fails to furnish the required Performance Guarantee within the timeframe specified in the Letter of Award;
• e) Fails to comply with any material condition of the award; or
• f) Otherwise fails to fulfill its obligations arising from the bidding process.

4. Extension of Bid Submission Deadline

To allow sufficient time for responding to technical and specification-related queries raised by prospective bidders and to provide adequate time for arranging the required Bid Security, the bid submission deadline is hereby extended by one (1) week.

5. Acknowledgement

Bidders shall take this Addendum into account when preparing and submitting their bids. This Addendum shall form an integral part of the Tender Document.
