• Bidder Certification of Compliance Form Bidder has failed to provide in the Bidder Certification of Compliance Form information about contracts similar to the proposed Works in the number, value, and period  Reference: ITB 37.4(c)
• History of non-performing contracts Non-performance of a contract did not occur within the last 5 years prior to the deadline for Bid submission, based on all information on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the bidder have been exhausted Reference: ITB 37.4(d)
• major relevant contracts successfully completed Bidder has failed to provide in the Bidder Certification of Compliance Form information about major relevant contracts successfully completed  Reference: ITB 37.4 (a)
• Historical Financial Performance Submission of audited balance sheets and other financial statements as required in the BDS Clause 17, for the past 5 years to demonstrate the current soundness of the Bidder's financial position and its prospective long-term profitability. Reference: ITB 37.5 (b)
• Financial Resources  The Bidder must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the cash-flow requirement. Reference: ITB 37.5 (a)
• General experience General experience in Construction Sector as Contractor, Subcontractor and Joint Venture Minimum 5 years' experience,  Reference: ITB 37.4
• Pending litigation All pending litigation shall in total not represent more than 10 percent of the Bidder’s net worth and shall be treated as resolved against the Bidder. Reference: ITB 37.4(e)
• Annual Turnover The Peak annual turnover calculated as total certified construction work payments received for contracts in progress or completed within the past Five years. Reference: ITB37.5(d)
• personnel for the key positions Bidder has to demonstrate in its Technical Proposal that it will have the personnel for the key positions that meet requirements  Reference: ITB 37.3 (c)

Bidder has to provide in the Bidder Certification of Compliance Form information related to its professional qualification and capability for the period specified in the BDS Clause 15.1;

Beneficial Ownership Disclosure Form 

In case of Partnerships, Consortium or Joint Ventures, the bidder submit a separate Beneficial Ownership Disclosure Form for each member; disclose at least one of the following: -

1)    Directly or indirectly holding 10% or more of the shares.

2)    Directly or indirectly holding 10% or more of the Voting Rights or

3)    Directly or indirectly having the right to appoint a majority of the board of Directors or an equivalent governing body of the consultant or

4)    Whether a person directly or indirectly exercises significant influence or control over the Company (tendered)

 In the case of a bid submitted by a Partnership, Consortium or a joint venture (JV), the Bidder has to submit the Form Data on Partnership, Consortium or Joint Ventures, the Agreement governing the formation of joint venture, or letter of intent to form Partnership, Consortium or Joint Venture, including a draft agreement, in accordance with ITB Clause 4.1.

 Bidder has to submit a valid tax clearance certificate issued by the tax authority in accordance with ITB Clause 4.5(b)(iii).

Bidder does have nationality in accordance with ITB Clause 4.2.

VAT registration certificate 

 Bidder has to submit VAT registration certificate issued by the tax authority (in case of contract value specified in BDS Clause 4.5(b)(ii)), in accordance with ITB Clause 4. 5(b)(ii).;

Business organization Registration certificate 

Bidder has to submit business organization registration certificate in accordance with ITB Clause 4.5(c).

Debarment 

 Bidder has not been debarred by a decision of the Public Procurement and Property Administration Authority from participating in public procurements for breach of its obligation under previous contracts, in accordance with ITB Clause 4.3;

Specific Experiance 

Bidder has to submit Certificates of satisfactory execution of contracts provided by contracting parties to the contracts successfully completed in the period and budget as specified in the BDS Clause 16.3 with a budget of at least 80,000,000.00, that of this contract.
