Mekidelamba University: Procurement of Water Supply and Sanitation Works

Submission of audited balance sheets and other financial statements as required in the BDS Clause 17, for the past Five years (2013-2017 EC) to demonstrate the current soundness of the Bidder's financial position and its prospective long-term profitability. A bidder's financial position is assumed to be sound if there is a consistent increase in the net worth of the bidder.

The audited balance sheet submitted by the bidder has to be checked against the recorders obtained from the concerned revenue and customs authority..

The Bidder must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the cash-flow requirement. (20 million ETH birr)

The Peak annual volume of construction work over the past five years (2013-2017 EC) of at least  50,000,000.00 (Fifty Million and 00/100).

For Joint Venture: - the average volume of construction for the past Five Years (2013-2017 EC) of at least 21,812,870.23 (Twenty-One Million Eight Hundred Twelve Thousand Eight Hundred Seventy and 23/100).

The yearly annual turnover for domestic or local bidders shall be considered the maximum one from the yearly annual turnover within the last five years (2013-2017 EC) should be submitted and must demonstrate the soundness of bidder’s financial position. A bidder's financial position is assumed to be sound if there is a consistent increase in the net worth of the bidder.

The submitted value shall be accepted only if it is verified with supporting evidence by revenue agency. No evaluation points will be given without the original direct auditor’s report and authenticated auditor’s report document evidence from revenue.

Bidder has to submit valid business license indicating the stream of business in which the Bidder is engaged, in accordance with ITB Clause 4.5(b)(i);

In case of Partnerships, Consortium or Joint Ventures, the bidder submit a separate Beneficial Ownership Disclosure Form for each member; disclose at least one of the following: -

1)    Directly or indirectly holding 10% or more of the shares.

2)    Directly or indirectly holding 10% or more of the Voting Rights or

3)    Directly or indirectly having the right to appoint a majority of the board of Directors or an equivalent governing body of the consultant or

4)    Whether a person directly or indirectly exercises significant influence or control over the Company (tendered)

 In the case of a bid submitted by a Partnership, Consortium or a joint venture (JV), the Bidder has to submit the Form Data on Partnership, Consortium or Joint Ventures, the Agreement governing the formation of joint venture, or letter of intent to form Partnership, Consortium or Joint Venture, including a draft agreement, in accordance with ITB Clause 4.1.

 Bidder has to submit a valid tax clearance certificate issued by the tax authority in accordance with ITB Clause 4.5(b)(iii).

 Bidder has to submit VAT registration certificate issued by the tax authority (in case of contract value specified in BDS Clause 4.5(b)(ii)), in accordance with ITB Clause 4. 5(b)(ii).;

 Bidder has not been debarred by a decision of the Public Procurement and Property Administration Authority from participating in public procurements for breach of its obligation under previous contracts, in accordance with ITB Clause 4.3;

Bidder is found to have a conflict of interest as described in ITB Clause 6;

Bidder has to submit business organization registration certificate in accordance with ITB Clause 4.5(c).

Among the staff mentioned in Sub-Clause 2.1 Bidder must demonstrate that it will have the personnel for the key positions that meet the following requirements

Bidder has to provide in the Bidder Certification of Compliance Form information related to its professional qualification and capability for the period specified in the BDS Clause 15.1;

Bidder has to submit relevant professional practice certificates, if required in BDS Clause 4.5(b)(iv).

Bidder has failed to provide CVs of the Professional staff signed by the staff themselves or by the authorized representative of the Professional Staff.

Bidder has to provide in the Bidder Certification of Compliance Form information about contracts similar to the proposed Works in the number, value, and period 

The Bidder has successfully participated as contractor, or subcontractor, in one similar building construction works of a nature & complexity over the last 5 Years, (2013-2017 EC). (To comply with requirement, works cited should be at least 70 percent complete); value of work shall not be less than Birr 130,000,000.00 (One hundred Thirty million). Supporting evidence for satisfactory performance from the employer which is clearly mention the project amount[ is mandatory and must be attached.

Or

The Bidder has successfully participated as contractor, or sub-contractor, in Two similar building construction works of nature & complexity over the last 5 years, (2013-2017 EC). (To comply with this requirement, works cited should be at least 70 Percent complete); value of work shall not be less than Birr 65,000,000/Sixty Five Million). Supporting evidence for satisfactory performance from the employer which is clearly mention the project amount is mandatory and must be attached

All pending litigation shall in total not represent more than 5 percent of the Bidder’s net worth and shall be treated as resolved against the Bidder.

Non-performance of a contract did not occur within the last [5 ] years prior to the deadline for Bid submission, based on all information on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the bidder have been exhausted
