A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the bidder have been exhausted. Reference: ITB 37.4(d)
• Pending litigationAll pending litigation shall in total not represent more than 10 percent of the Bidder’s net worth and shall be treated as resolved against the Bidder. N.B. The audited report must be original or authenticated copy. It shall include Statement of Financial Position (Balance Sheet), Statement of Comprehensive Income (Profit & Loss Statement), Statement of Cash Flows, Notes to the Financial Statements. Bank Reference Letter(s): A letter from the bidder's principal bank(s) confirming their account(s) are active, in good standing, satisfactory relationship with the bank, and their creditworthiness shall also be submitted. Note the following Bidders Audit Report should be confirmed with the records approved by the Customs and Inland Revenue Authority. Bidders must attach renewed legal documents for the year 2017 E.C. of the Chartered Certified Auditor. Reference: ITB 37.5 (b)
• Financial Resources Bidder must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the following cash-flow requirement: Liquid assets and/or credit facilities, net of other contractual commitments an d exclusive of any advance payments which may be made under the Contract, should be demonstrated that the bidder has access to, or has available, liqui d assets, lines of credit, overdraft facility and other financial means sufficient to meet the construction cash flow estimated as 60 million Birr. Reference: ITB 37.5 (a)

Specific Experiance

The Bidder must have completed, withi n the past ten years, at least one construction project similar in nature to the proposed works with a value of at least ETB 520 million with one project or experience across three complete d projects of similar nature may also be submitted, provided the cumulative value is not less than one-third of the required threshold. The contractor must have completed at least 70% o f the work in a satisfactory an d acceptable manner, either as a sole contractor, joint venture member, or subcontractor, within the agree d schedule, including any approve d extensions, and where a certificate o f satisfactory completion, payment certificate, or other verifiable documentation from the client confirms that the required quality standards have been achieved.
