Qualification Requirements

• Annual Turnover The minimum average annual turnover required from the Bidder is ETB 200,000,000 (Two Hundred Million Birr), calculated as total certified payments received for contracts in progress or completed over the last three (3) years. Reference: ITB 35.5
• Agency Agreement Official agency agreement between the manufacturer and the bidder. Reference: ITB 35.4
• Valid business license Bidder has to submit valid business license indicating the stream of business in which the bidder is engaged in accordance with ITB Clause 4.6(b)(i); Reference: ITB 35.2
• VAT registration certificate Bidder has to submit VAT registration certificate issued by the tax authority (in case of contract value specified in BDS Clause 4.6(b)(ii) Reference: ITB 35.2
• Properties Sampling and Testing (Fundamental) The entire required asphalt grade designated shall conform to the specification requirements shown in the table and the final confirmation tests will be carried out in locally available certified laboratory in Addis Ababa after delivery. Reference: ITB 35.4
• External Audit Reports External Audit Reports (for the last 3 Years) certified by an independent auditor.Note: Financial statements prepared by accounting firms or accountants will not be accepted. Reference: ITB 35.5
• Nationality Bidder's have nationality in accordance with ITB Sub-Clause 4.2. Reference: ITB 35.2
• Scope It is the intent of these specifications, whether or not specifically mentioned here in, to describe:·    Penetration graded asphalt cement Mc-30 and Mc-3000·    To be used in the high way pavement and treatment of road surfaces. Reference: ITB 35.4
• Descriptive Technical Literature Literature describing the product specification, characteristics, and test results in detail, including references to recognized international standards. Reference: ITB 35.4
• Manufacture  The asphalt cement shall be prepared by the refining of crude petroleum by suitable methods.·    It shall not show separation or curdling prior to use,·    Shall not foam when heated to the application temperature;·    The asphalt shall be homogeneous throughout the packing Reference: ITB 35.4
• Valid tax clearance certificate Bidder has to submit a valid tax clearance certificate issued by the tax authority in accordance with ITB Clause 4.6(b)(iii);  Reference: ITB 35.2
• Signed & Stamped Technical Compliance Sheet Clause-by-clause commentary confirming full compliance with ALL technical specification requirements (including properties: showing no separation, no foam when heated, and homogeneous). Reference: ITB 35.4
• Financial statements certified by an independent auditor  Bidder has to submit financial statements certified by an independent auditor as required in ITB Clause 15.2(a) for the period specified. Reference: ITB 35.5
• Conflict of interest Bidder is found to have a conflict of interest as described in ITB Sub-Clause 4.3  Reference: ITB 35.2
• Joint Venture Agreement & Data Form The legally binding agreement AND the standard "Form - Data on Joint Venture/Consortium" from Section 4 (Only if participating in a JV). Reference: 2
• Memorandum and Articles of Association The officially authenticated Memorandum and Articles of Association (የመመስረቻ ጽሑፍ እና መተዳደሪያ ደንብ) detailing the company's formation, ownership structure, and operational guidelines Reference: 3
• Supplier list Bidder has to register itself in the electronic government procurement system as suppliers list (mandatory for all bidders ) in accordance with ITB Clause 4.7 Reference: ITB 35.2
• Written Power of Attorney A legal document granting the agent the authority to sign contracts and submit bids on behalf of the manufacturer/international company. Reference: 3
• Anti-Bribery/Corruption Declaration A signed declaration confirming the bidder's commitment to ethical business practices and compliance with anti-bribery and corruption laws. Reference: 3
• Bid Submission Sheet The standard signed and stamped Bid Submission Sheet declaring adherence to all terms of the bidding document. Reference: 3
• Margin of Preference Evidence (Optional) If claiming local preference, a Value Added Certificate certified by an external auditor, or valid MSE/Women/Disability association support letters. Reference: 3
• Bidder Certification of Compliance The standard signed and stamped form proving financial standing, experience, and legal representation. Reference: 3
• Beneficial Ownership Disclosure Form A fully completed form disclosing the identities of all beneficial owners (individuals holding 10% or more shares/voting rights) per ITB 4.9 & Section 4.ITB 4.9 & 35.2(j) Reference: 3
• Certificates of satisfactory execution of contracts Bidder has to submit Certificates of satisfactory execution of contracts provided by contracting parties to the contracts successfully completed in the period and budget as specified in the BDS Clause 16.3; Reference: 3
• Certificate of Origin Documentary evidence certifying the country of origin of the goods being offered. Reference: 2
• Manufacturer's Quality and Safety Certifications Evidence of valid certifications (e.g., ISO, CE, ASTM, DIN, JIS, TUV, or equivalent) for the offered product. Authenticity is emphasized, requiring certificate numbers and accreditation body addresses. Reference: 3
• Onsite Warranty Letter Letter guaranteeing to replace defective parts free of charge (including transport and labor up to ERA warehouse) within twelve (12) months. Must warrant that asphalt is non-recycled, unused, and not more than 6 months old from manufacture date when shipped (per Fundamental Spec Clause 6). Reference: 3
• Certification Letter of Test Result (COA) Most recent 3rd party test result attached, certifying compliance with AASHTO M20-70 / ASTM standards. Certificate must indicate test date (must be after floating of this tender). Bidder must commit to accept local testing in Addis Ababa after delivery (per Fundamental Spec 3 & 4). Reference: 3
• Manufacture  Reference: 3
  • The asphalt shall show no separation or curdling prior to use.
  • It shall not foam when heated to the application temperature.
  • It shall be homogeneous throughout the packing.
• Period of Validity of Bids The Bid and the prices quoted by the Bidder shall remain valid and open for acceptance for a period of 60 calendar days from the Bid Submission Deadline. Reference: 3
• Information about major relevant contracts successfully completed Bidder has failed to provide in the Bidder Certification of Compliance Form information about major relevant contracts successfully completed in the number and period specified in the BDS Reference: 3
• Specification Waiver The right is reserved by the Ethiopian Roads Administration to waive compliance on any of these specifications and make awards based upon its best interests. Reference: 2
• Delivery and Completion Schedule Bidder has failed to submit dated Delivery and Completion Schedule presented as per template in Section 6, Statement of Requirements Reference: 2
• Technical Specification + Technical Offer+ Compliance Sheet Bidder has failed to complete its Technical Specification + Technical Offer+ Compliance Sheet Form in accordance with technical specification presented as per template in Section 6, Statement of Requirements .The Public Body reserves the right to undertake physical checking of current Bidder's technical qualifications and competence (stock).  Reference: 3
• Origin of the Goods and Related Services Bidder has failed to provide in the Bid Submission Sheet Form the Statement attesting the origin of the Goods and Related Services offered Reference: 3
• Warranty Bidder has to submit Description of the organization of the warranty offered in accordance with the conditions laid down in GCC Clause 23; Reference: 3
• Manufacturer Authorization Letter Bidder has to submit Manufacturer Authorization Letter in accordance with ITB Clause 5.6. Reference: 3
• Bid Security A Bid Security in the amount of 300,000 ETB must be submitted in the form of an unconditional Bank Guarantee or a CPO.Note: Reference: 3
  • Bidders are required to submit the bid security in hardcopy to the designated address before the bid submission deadline, using the form attached in this bidding document in the name of Ethiopian Roads Administration.
  • Failure to submit the hardcopy bid security as specified will result in the rejection of the bid.
